检察机关案例指导制度若干问题探析 |

| 摘 要： 检察机关案例指导制度的推出，反映了中国司法改革的渐进，它是判例制度最终在中国建立的阶段性步骤。现行指导性案例的法律定位不明，缺乏强制力，选编及适用等配套制度不够健全，对司法实践难以发挥有效作用。该制度的完善，必须明确案例作为司法解释原始形式这一法律属性的定位，统一选编主体、规范选编标准、完善编纂体例。在案例适用问题上，应建立当事人提出与上级检察院监督、社会监督等多元化主体机制以及检察官对区别技术的掌握等系列配套制度。 |

On some problems about case guiding of the procuratorial organ |

| Abstract: Guiding cases system reflects that the Chinese judicial reform is conservative, or China begins to gradually establish the case precedent system. The current procuratorate guiding case, whose law orientation is not clear, also lacks binding force and matching system, is difficult to play an effective role in the judicial practice. Improving the prosecution of the case guiding system, should not only correctly understand and position the law attribute of guiding case as a new form of judicial interpretation, but also unify the dominant subject, improve the standard, and perfect the compilation style. It is necessary to establish the parties, social and the superior institute of supervision mechanism, improve the prosecutor’s technology and establish other series of supporting system. |
