新疆兵团屯垦戍边合法性及潜在合法性危机探析 |

| 摘 要： 兵团是新疆的重要组成部分，对新疆的发展和稳定发挥着重要作用。改革开放后，国家进入和平发展时期，社会主义市场经济改革深入，但兵团体制优势未能得到充分发挥，这引起了学者们对兵团未来前途和发展的关注。兵团现实存在既有历史的依据，又有现实的基础。兵团的转变和体制改革面临的困境容易造成不必要的误解，因而正确认识兵团屯垦戍边的和平时期转变和兵团体制困境十分必要。兵团潜在合法性危机的根源在于兵团屯垦戍边的法律地位问题，因此，明确兵团法律地位是当务之急。 |

On legitimacy of Xinjiang Production and Construction Corps |

| Abstract: Xinjiang Production and Construction Corps is an important part of Xinjiang and plays a vital role in Xinjiang. After reform and opening-up, the advantages of the Corps system can’t be fully realized with the entry into peace and development era and the depth of socialist market economic reform. Therefore, plenty of people who care about its development and future focus on the problem again. The authors analyze the basis of legitimacy of the Corps from history and reality dimensions and believe that people should correctly recognize the change and dilemma of the Corps, the authors also suggest the possibility of potential crisis of the Corps and propose that the Corps should establish its legal status. |
