| 摘 要： 在当前的法学翻译与研究领域，存在着一种译者高度赞扬所译作品并在其影响下进行研究的进路，这是一种值得警惕的法学翻译与研究方法。它不仅容易导致全盘西化论式的简单化思维方式，而且容易丧失学术研究的真正品格。我们在警惕这种翻译与研究进路的同时，更应该思考一种替代性进路的可能性，并逐步形成中国法学的研究传统。 |

On the approach to the translation and study of law |

| Abstract: At present, there is an approach with which the translators sing high praise for the translated works and conduct their studies under the influence of them in the area of translation and study of law. The path is alerting in that it will not only lead to a kind of simplified thinking manner of total Westernization, but also lead to the loss of the character of academic study. When we try to avoid this kind of path, the possibility of replacing it should be pondered and the tradition of our study of law should be constructed step by step. |
