| 摘 要： 通过对不法行为责任上的主观因素的分析，可以准确、恰当地确定具体的国家行为是否构成了国际不法行为，以及所引起的第二性赔偿责任的具体种类、程度、大小等，从而可以有效地恢复被损害的国际秩序及相关利益，并可防范、遏制潜在的国际不法行为，以实现国际社会中良好的治理秩序。 |

Subject factor in responsibility for international wrongful acts |

| Abstract: Based on an analysis of subject factor in responsibility for international wrongful acts, we can more correctly confirm whether the concrete state behavior constitutes international wrongful acts and its secondary responsibility, and whose category, degree and so on. International order and correlative rights damaged by international wrongful acts can be consequently repaired. Potential international wrongful acts may be prevented and deterred, and favorable governance order of international community can be achieved. |
