技术标准专利许可中的合理非歧视原则 |

| 摘 要： 合理非歧视原则是技术标准专利许可的重要原则，对于保证技术标准的顺利制定和有效实施具有重要作用。在合理原则中要区分专利技术与技术标准在产品需求中的贡献，也需要考虑技术市场竞争对专利权人收取许可费的影响。对于非歧视原则要注意其与反垄断法适用的关系，特别是不应对竞争者应当获得的收益造成不合理的挤压。应当发挥标准化组织在确定合理非歧视许可费中的作用。 |

Reasonable and Non-discriminational Rule of patent licensing in

| Abstract: Reasonable and Non-disciminational Rule is very important in the patent licenisng in Technical standards to guarantee the fomation and enforcement of standards. The rule of reason requires the division of function of patent technology and technical standards, as well as the competition between the patentees. The Rule of Non-discrimination requires the application of antitrust law in standard patent licensing, especially not to squeeze the profit reasonable to competitors. The funcition fo Standard-Setting organizations should be promoted. |
