Abstract: Cutting off the supply of water and/or electricity is an effective way in preventing and controlling water pollution, but water and electricity are basic needs of people, cutting off the supply will infringe certain fundamental human rights and violate the principle of necessity, which is confirmed in the draft of Administrative Compulsory Enforcement Law of China. The principle of necessity is, however, only one component of proportionality, which can not stand for the whole. Nowadays, to control administrative power is not the only aim of administrative law. It is wiser to take proportionality other than necessity to review the legitimacy of regulations. |
