我国刑事被害人救助制度价值分析与立法设想 |

| 摘 要： 刑事被害人救助制度作为国家建立的特殊救济制度，主要针对因刑事损害遭受严重损失但又无法获得有效民事救济的刑事被害人提供必要物质保障。刑事被害人救助制度具有法理学和司法实务上的重要制度价值，需要通过立法加以规范与保障。要通过救助对象、救助条件、救助程序等方面的完备立法，进一步有效保障刑事被害人的合法权益。 |

Value analysis and legislation design of China’s compensation system for criminal victims |

| Abstract: As a special remedy system constructed by the country, compensation system for criminal victims mainly offers substantial supply for those criminal victims, who lose a lot in the crimes but can’t gain complete civil compensation. Compensation System for criminal victims is of important system values of jurisprudence and judicial work but needs legislative bounce and protection. We should establish complete legislation of the object, conditions and patterns so as to offer more protection for the legitimate rights and interests of criminal victims. |
