信誉的法律基础——与张维迎先生商榷 |

| 摘 要： 市场经济是法治经济，也是信誉经济。在法律与信誉的关系上，张维迎先生提出的“信誉是法律制度的基础”的观点是值得商榷的。相反，法律是信誉的基础，是维护信誉的保障力量。当代中国市场信誉的缺失，主要原因是执法乏力和执法腐败。打造“信誉中国”，必须加强法治建设。 |

| Abstract: Market economy should be a kind of economy ruled by law as well as with great reputation. On the relationship between the law and the reputation, the author doesn′t agree that reputation is the basis of law suggested by Mr Zhang Wei-ying, and insists that the law is the basis and safeguard of it. The main reasons for the lack of reputation in China's contemporary market are the incapability of enforcing the law and the corruption in enforcing the law. To create a highly credible China market, we must make efforts to create an environment governed by the law. |
