Abstract: There are lawsuit and prohibition etc. ways of relief abroad for the relief of proxy detecting solicitation ,but There is not normal relief way to this in our country, by comparison. The article suggested that we should set up mechanism of relieving separately appoint to the concrete conditions of the flaw proxy solicitation in our country : If the flaw collecting has not been finished yet, the man who is soliced may apply to the people′s court, send out prohibitions to forbid the collecting going on; If the flaw collecting has already been finished , the man who solicits could adopt the lawsuit of confirming invalid or recalling to prevent the execution.） |
