国际消费侵权纠纷的法律适用

摘要:在全球化趋势不断增强的今天，国际民商事交往日益纷繁复杂，国际消费侵权纠纷成比例递增。处于经济弱势地位的国际消费者，只能选择最有利于保护自己利益的国家的法律来抗衡侵权的“强势”商人。国际私法中的法律适用规则用于国际消费侵权纠纷会出现以下几种情况，即适用侵权行为地法、重叠适用法院地法和侵权行为地法、适用消费者惯常居所地法、适用最有利于保护消费者利益的法律。但近来有些国家的民商事审判实践中已出现了适用侵权行为自体法的新趋势。

Application of law of the international consume delict |

| Abstract: With the trend of globalization strengthening continuously in the world, international civil and commercial activities are more complicated, and the cases of international consume delicts have doubled. International consumer who is in weak economic status has to select the law that could protect his own benefits for against the stronger economic traders. The rules of private international law to the law application will be as follows: lex loci delictus, lex fori and lex loci delictus,lex habitual residence,the law of most beneficial to consumer. Recently a new tendency of application of proper law of torts has been in practice in some countries. |
