| 摘 要： 考文借高级法为美国宪法的至上性提供了一种解说。依循考文的思路,阐释了4个相互关联的问题:高级法如何使得权力获得正当性、合法性;高级法怎样在宪政实践中获得效力,使得宪法成为“更高级的法”;对立法权构成实际限制的司法审查制度与高级法有着什么样的内在关联;我们从考文的高级法那里可以得到哪些有价值的启示。 |

| Abstract: Higher lawpresented byProfessorKorwin accounts forthe paramountcyofAmerican constitution law. As a supplement, the article explains fourrelated propositions: Higher lawmade power just and legitimate; As an impetus, higher law acquired validity in constitutional practice and made the constitution acquire a sense of“higher law”; Judicial review which framed a limitation on legislature has an internal relationship with higher law; China can acquire aspiration from the higher law presented by Korwin. |
