“法律监督”内涵正解 |

| 摘 要： “法律监督”作为宪法对检察机关的界定，它界定的是我国检察机关的性质。正确解读“法律监督”的内涵是认识我国检察机关本质的必由之路。基于“法律监督”产生的背景及其在检察理论范畴体系中基石范畴的地位，“法律监督”的内涵包含三个层面：检察机关承担的任务、使命，检察职能，检察职能的实现机制及其实现效果，以及三个层面分别体现的政治价值、规范价值、实践价值。只有对这三个层面的内涵及其相互关系进行了系统深刻的分析，才能准确解读“法律监督”的内涵，也才能准确把握我国检察机关的本质。 |

An interpretation of connotation of legal supervision |

| Abstract: Legal supervision as defined of the prosecution in the Constitution defines the nature of the prosecution branch. The correct interpretation of legal supervision is the only way to recognize the nature of the prosecution branch. In our view, based on the background and scope of the Public Prosecutor's theory, the content of the legal supervision consists of three levels: the prosecution tasks, mission, prosecuting functions, the realization mechanism and implementation results of prosecuting functions, as well as values respectively displayed at the three levels: to embody the political values, norms values, practical value. Only when we make a systematic in-depth analysis on their meaning and mutual relations of three levels, can we accurately interpret the content of legal supervision, and grasp the essence of the prosecution branch. |
