基层矛盾纠纷调处的“小马拉大车”问题及其纾解——以专业性社会组织赋能为路径 |

| 摘 要： 实现基层矛盾纠纷的善治，具有筑牢国家安全和社会稳定根基的重要价值。当前我国的基层矛盾纠纷化解实践面临着“小马拉大车”的结构性困境，基层治理主体所保有的权力、资源和能力与矛盾纠纷聚集基层且愈发复杂、强烈的表达样态不甚匹配。实践证明，单纯依靠政治、行政和司法资源向基层下沉不足以从根本上解决问题。在国家与社会密切互动的崭新治理格局中，将新质态的“专业性社会组织”引入基层矛盾治理格局，是构成“壮马拉轻车”的重要解纷机制创新。专业性社会组织具有的组织制度性、专业技术性、群众亲和性、公信中立性、网络链接性等显著优势可以转化为基层实质性化解矛盾纠纷的治理效能。 |

| Abstract: Achieving the good governance of grassroots conflicts and disputes is of significant importance for fortifying the foundation of national security and social stability. Currently, China's practices in resolving grassroots conflicts and disputes are confronted with a structural dilemma akin to “a small horse pulling a heavy cart,” where the power, resources, and capabilities retained by grassroots governance entities are insufficient to address the increasingly complex and intense expressions of conflicts and disputes concentrated at the grassroots level. Relevant practice has shown that merely relying on the downward allocation of political, administrative, and judicial resources to the grassroots level is inadequate to fundamentally resolve the issue. In the new governance framework characterized by close state-society interaction, introducing new forms of “professional social organizations” into the grassroots conflict governance structure represents an innovative mechanism for dispute resolution that constitutes “a strong horse pulling a light cart.” Significant advantages of professional social organizations, including institutional robustness, professional expertise, public affinity, credibility and neutrality, and network connectivity, can be transformed into effective governance capabilities for the substantive resolution of conflicts and disputes at the grassroots level. |
