区域发展权的权利结构与实现路径 |

| 摘 要： 区域发展权是促进区域协调发展法治化的逻辑起点，厘清区域发展权的权利结构对助力权利实现、平衡区域发展利益、促进区域全面发展至关重要。依循传统权利结构“内容、主体、客体”三要素理论，区域发展权是一个以“区域发展利益”为核心内容、以“区域”为权利主体、以“资源资产”为基础权利客体的集合性权利。区域发展权的实现离不开对区域利益格局的调整、区域主体地位的认可及资源资产产权的整体保护。为此，必须加强国家立法保障，促进区域理性合作，增强区域内生动力，构建由外源到内生的区域发展权实现路径。 |

The rights structure and realization path of the regional development right |

| Abstract: The regional development right is the logical starting point for promoting the legalization of coordinated regional development, and clarifying the rights structure of the regional development right is crucial for facilitating the realization of rights, balancing regional development interests, and promoting comprehensive regional development. Following the traditional theory of the three elements of “content, subject, and object” in the structure of rights, this article holds that the regional development right is a collective right with “regional development interests” as the core content, “region” as the subject of rights, and “resource assets” as the basic object of rights. The realization of the regional development right cannot be separated from the adjustment of regional interest patterns, recognition of regional subject status, and overall protection of regional resource asset property rights. Therefore, it is essential to strengthen national legislative protection, promote regional rational cooperation, enhance regional endogenous driving force, and build a realization path from the exogenous to the endogenous. |
