教育法典中法律救济体系之构建 |

摘 要: 救济是保障权利实现的程序化机制。教育法律救济制度的完备程度是检验受教育权能否实现的重要标准,因而有必要将其纳入教育法典。在建构教育法典的救济体系时,应以基本权利保护为理念,以纠纷实质化解为目标,以体系化为方法。在体系化的具体方式上,应理顺非诉法律救济制度的内部关系,妥善衔接非诉与诉讼法律救济制度,寻求司法谦抑与司法能动的平衡点。由于教育法典宜采“总则+分则”的编排形式,救济规范也应以此为据,妥善安排。为体现适度法典化的指导思想,救济体系宜以“确认规定”和“确认+转致规定”的方式呈现,并厘清内部逻辑顺序,以保证法典精炼、准确。 |

The construction of legal relief system in education code |

Abstract: Relief is a procedural mechanism to ensure the realization of rights. The perfection level of educational legal relief system is an important criterion to test whether educational rights can be realized, so it is necessary to incorporate it into the education code. When constructing the relief system of educational code, we should take the protection of basic rights as the concept, the substantive resolution of disputes as the goal, and the systematization as the method. In the specific way of systematization, we should straighten out the internal relationship of the non-litigation legal relief system, properly link up the non-litigation legal relief system with the litigation legal relief system, and seek the balance point between judicial modesty and judicial activism. Because the educational code should be arranged in the form of “general provisions + specific provisions”, the relief norms should also be properly arranged on this basis. In order to embody the guiding ideology of appropriate codification, the relief system should be presented in the form of “confirmation provisions” and “confirmation provisions + transfer provisions”, and the internal logical order should be clarified to ensure the refinement and accuracy of the code. |
