我国职务舞蹈作品著作权归属问题的疏解路径 |

| 摘 要： 我国职务舞蹈作品的创作和传播具有显著的体制特征，而法律法规尚无针对此类作品的专门著作权归属规则，致使实践中权属认定的法律适用存在较大不确定性。解决职务舞蹈作品著作权归属问题，应在充分考量编导的独创性贡献、舞蹈作品及其创作的独特性、职务舞蹈作品创作体制的特殊性以及法律解释和政策激励机制的有效性诸要素的基础上，从法治、政府治理、行业自律三个方面展开：将职务作品著作权归属的一般规则与专门规则相结合，合理确立职务舞蹈作品的权属；针对舞蹈行业的特性，制定促进性部门规章、政策和行业标准；通过行业自律公约促进形成尊重舞蹈作品著作权的行为自觉。 |

The issue and solutions concerning copyright ownership of service dance works in China |

| Abstract: The creation and dissemination of service dance works in China have striking institutional characteristics, but there are no specialized rules for the ownership of the copyright of such works in laws and regulations, which results in considerable uncertainty in the legal application of ownership identification in practice. The path to solving the copyright ownership of service dance works should be based on fully considering the factors of the original creative contribution of choreographers, the uniqueness of dance works and their creation, the special nature of the service dance creation system, and the effectiveness of legal interpretation and policy incentives. Besides, the solutions should be implemented from such three aspects as rule of law, government governance, and industry self-discipline: reasonably establishing the ownership of service dance works by combining general rules and specialized rules for the ownership of copyright; formulating promotional departmental regulations, policies, and industry standards for the dance industry with particular attention to the peculiarity of dance works; promoting the formation of behavior consciousness that respects dance copyright through self-discipline conventions of the industry. |
