论监察体制改革背景下的检察官惩戒制度 |

| 摘 要： 国家监察体制改革已经进入持续深化的新阶段，而监察制度与检察官惩戒制度之间的不协调却逐渐显现出来。从目前的相关规定以及实践运行效果来看，新监察制度在管辖范围、被调查行为的判断标准和处置权行使与检察官惩戒制度存在冲突，其冲突实质来源于国家权力统一管理下的检察职业化管理。国家虽然对权力进行全方位的统一管理，但还需为检察职业化建设留有空间。因此，有必要在监察体制改革的背景下重申检察官惩戒制度的重要意义，在发挥监察体制改革对检察官惩戒制度建设倒逼作用的同时，从厘清监察制度与检察官惩戒制度的管辖范围、构建以《检察官法》和《检察官职业伦理》为核心的职业规范体系，以及明确监察制度与惩戒制度管辖重叠的处理原则和方式，来消解新监察制度与检察官惩戒制度的冲突。 |

On the prosecutor's disciplinary system in the context of supervision system |

| Abstract: The reform of the national supervision system has entered a new stage of continuous deepening. However, the discord between the supervision system and the prosecutor's disciplinary system has gradually emerged. Judging from the current relevant regulations and the effect of practical operation, the new supervision system is in conflict with the prosecutor's disciplinary system in such aspects as the range of governance, the judgment standards of the investigated behavior, and the exercise of disposal right. Essentially, the conflict comes from professional management of inspections under the unified management of state power. Although the state exercises comprehensive and unified management of power, it still needs to leave room for the professional construction of procuratorial work. Therefore, it is necessary to reaffirm the significance of the prosecutor's punishment system in the context of the reform of the supervisory system, to clarify the range of management of the supervisory system and the prosecutor's punishment at the same time of exerting the obstructive effect of the reform of the supervisory system on the construction of the prosecutor's punishment system, to construct a professional regulated system with Prosecutor's Law and Prosecutor's Professional Ethics as the core, and to specify the principles and methods of dealing with the overlap of jurisdiction between the supervision system and the punishment system so as to eliminate the conflicts between the new supervision system and prosecutor's punishment system. |
