律师扰乱法庭秩序的惩戒:困境与纾解 |

摘 要: 律师扰乱法庭秩序会受到律师惩戒制度的规制,惩戒措施包括司法权领域的实体性制裁与程序性制裁、行政权领域的行政处罚以及律师协会的纪律处分。现有的律师惩戒制度呈现出一定程度的惩戒权力配置混乱、惩戒权力行使恣意以及惩戒审查程序不足等困境。域外制度经验为中国问题的解决提供了一些基本规律参考。缓解扰乱法庭秩序行为的律师惩戒困境,需要坚持律师独立性原则、惩戒措施合比例原则以及正当程序原则,着力从惩戒权力的重新配置、惩戒权力的规范化以及惩戒程序的司法化加以纾解。权力的配置以职业自治与法庭秩序管理为主线,权力的规范化以划定惩戒次序与保障辩方权利为依托,程序的司法化则以审查程序与救济程序的完善为要旨。 |

Abstract: Disturbance against court order is an important action regulated by lawyers' disciplinary system. The measures for discipline include substantive and procedural sanctions entrusted by the judiciary power, administrative sanctions entrusted by administrative power and disciplinary sanctions entrusted by the Bar Association. The lawyers' disciplinary system demonstrates the plights that deployment of the disciplinary power is somewhat chaotic, exercise of the disciplinary power is reckless and the disciplinary review procedure is inadequate, etc. Some foreign experiences can be referred to in resolving Chinese issues. In order to resolve the plight for disciplining lawyers who disturb court order, it is necessary to insist on the principles of lawyers' independence, of punishment proportionality and of right process, and to embark on re-allocating the disciplinary power, regulating disciplinary power, and judicializing disciplinary procedure. The allocation of powers shall be premised upon professional autonomy and management for the court order, the regulaion of powers shall be mainly concerned with adjusting sequence for different types of punishments, and the judicialisation of procedure shall focus on the improvement of review and relief procedures. |
