积极守法：一个被忽视的法治维度 |

| 摘 要： 从法治实践来看，我们的守法观经历了从以服从为中心的消极守法观到以维权为中心的有限积极守法观的变迁，并已经有了朝以护法为中心的全新积极守法观进化的趋势。从法律规范性角度分析，积极守法可以分为法定的积极守法与法律未予以禁止的积极守法；从行为表现角度分析，积极守法可以分为制止与劝阻两类行为。从公共领域的视角来看，积极守法观其实是一种个体公民意识的表达，并能够在此基础上生成社会整体公民意识与公共理性。积极守法所蕴含的公民意识及公民参与的要求对破除臣民意识、建设法治社会与实现善治具有重要意义，是法治建设的一个重要维度。 |

Observing the law positively:a neglected dimension of rule by law |

| Abstract: From the perspective of law practice, our view of abiding by the law has experienced from the negative view of obey the law to the limited positive concept of observing the law, from obedience-centric to human rights-centric. And it has built up a brand new positive law-observing concept, centered on the protection of legal interests. In the view of the normalization of law, observing the law positively can be divided into the legal part and the part on which the law does not impose banning. From the analysis of behavior, observing the law positively can be divided into two types of behavior: inhibition and dissuasion. From the perspective of the public domain, observing the law positively is actually an expression of the consciousness of individual citizens. On this basis, the whole society can generate a citizen consciousness and public rationality. The citizen consciousness and the requirements of citizen participation implied in observing the law positively exert great impact on breaking the subject consciousness, constructing the society ruled by law, and realizing the good governance. Hence, observing constitutes the law positively an important dimension of the legal construction. |
