摘 要: 由于外派员工制度的结构较为复杂,涉及到多方主体利益,基于多个合同关系才能实施,因此,在员工和企业(单位)、企业(单位)与企业(单位)之间就损害赔偿如何承担的纠纷屡见不鲜。责任主体难以确定,责任承担方式无法落实,这都与外派员工制度本身的复杂性和多元性有直接关系。正确掌握外派员工制度需要从其多重合同关系入手,解决其中的法律纠纷则需要根据发生争议的双方当事人,确定具体的合同性质,选择恰当的法律规范。 |

Abstract: The structure of dispatched employees system is very complicated, which is related to multiple parties, based on different contracts relationship. So, a lot of disputes between employees and enterprise are found. To correctly correctly grasp this system must start from the multiple contracts, according to the disputes parties to determine the character of the contract and select the appropriate law form so as to resolve the legal disputes. |
