论“同妻”群体的生存困境与权利保障 |

| 摘 要： 当人们开始关注同性恋者的权利时，另一个与同性恋者紧密相关的群体也开始呈现在人们的视野中——“同妻”(男同性恋的妻子)。同妻不仅面临着配偶权和健康权被损害的现实，而且还面临着立法空白和司法救济的缺失。保障同妻的权利，首先应该是完善立法和司法救济；其次是呼吁更多的社会力量对这一群体提供帮助和支持；当然，解决同妻问题最为根本的措施在于推动社会对同性恋者的宽容，尊重同性恋者的婚姻自主权。从这个意义上讲，“同妻”的维权之路漫长而艰难。 |

| Abstract: There may be as many as 16 million women on the Chinese mainland who are married to homosexual men, whose right of health and right of spouse are threatened and lost, and they also face legislative gaps and the lack of judicial relief. How to protect those wives’s rights? Our solution is, firstly, to improve the legislative and judicial remedies; secondly, to call for more social forces to provide help and support for this group; and finally, the most fundamental solution is to promote social tolerance towards homosexuals, and to respect gay marriage autonomy. In this sense, it is difficult to protect those wives’s rights. |
