反思新道统法哲学的话语逻辑 |

| 摘 要： 新道统法哲学是针对“中国法学向何处去”之问而建构起来的一种法哲学。新道统法哲学通过中西之争和古今之辩而形成和发展起来，所以有必要对中西之争和古今之辩的话语逻辑进行分析。经研究发现，由于两者内含的辨析逻辑层次不一致而导致内在的紧张，需要对其中的逻辑进行合理解释和调整。由于新道统法哲学对知识论的逻辑没有交待清楚而导致诸多错误理解，因此需要对知识构建论的内在逻辑进行调整，以消除误解。 |

| Abstract: New Orthodoxy Philosophy of Law is a new point of Philosophy of Law, which is in connection with the question of which will go of the study of China Law. It is necessary to analyze the discourse logic of the dispute of the ancient and present and the dispute of China and West. The internal tension, connoted in the discriminative logic level between above two, has also been discovered, which needs a reasonable interpretation and adaptation. And we also find that this idea does not clearly explain the logic of theory of the knowledge constructionist, which leads to many misunderstanding. Therefore, we also need to adjust the logic. |
