英国治安法官制度对我国基层司法模式改革的启示 |

| 摘 要： 英国治安法官由最初颇具行政色彩的地方官吏，历经变迁，逐步成长为具有现代化基层司法模式的典范，在英国当前基层司法中作用突出。我国基层司法模式与英国治安法官制度颇为类似，因此我国可吸收英国经验，从法官分流、职能分化、明确基层司法职责三方面入手进行改革，最终实现基层司法模式的现代转型。 |

British justices of the peace system and its inspiration to reform of Chinese primary judicial model |

| Abstract: Justices of the Peace System is very important in the development of the rule of law in England, and attracts most scholars’ attention because of its transformation from official to judicial. The Chinese primary judicial model is, to a comparatively great extent, similar to the British justices of the peace system, from which we can draw inspiration for the reform in the following three aspects: branching the judge, separating the judge, dividing the power, and definiting the scope of the judicial duty. |
