疫学因果关系论在食品安全犯罪认定中的合理性及其限制

摘  要: 食品安全犯罪的公害罪性质,决定了需要引入疫学因果关系论。疫学因果关系论的合理性,体现在证明标准的高度盖然性以及刑法有用性与正义性之间的均衡。应用疫学因果关系论认定食品安全犯罪的条件关系,应当注意适用的范围、证明责任的归属和证明精确性、有效性的要求。

The Rationality and Restraint of Application of the Theory of Causation Based on Epidemiology in Crimes of Food Safety

Abstract: The nature of crimes of food safety determines the need of application of the theory of causation based on epidemiology. The rationality of the theory lies in the fact of its high standard of proof and the balance between justification and utility. It is critical to notice issues such as scope of application, burden of proof, accuracy and validity requirements of proof.
