论犯罪结果的本质 |

| 摘 要： 犯罪结果的单一本质学说或与犯罪客体相联，或者与犯罪对象相关。但这两类犯罪结果学说与刑法理论都存在矛盾之处。以单一本质为基础形成的多层次犯罪结果学说，不仅在划分技术上有瑕疵，且从两重本质的关系来看，犯罪客体侵害是对包含犯罪对象侵害的犯罪事实进行价值评价后得出的结论，不是因果意义上的结果。因此与犯罪客体相分离的、因果意义上的结果才是犯罪结果的本质。犯罪结果不仅是犯罪价值评价的素材，也与刑法在目的上意图防止的损害结果密切相关。所以在解释与运用上，犯罪结果应该与刑法的目的相关，且能够适用于结果犯与行为犯的认定，从而使对犯罪的通盘评价植根于犯罪事实。 |

On essence of the consequences of crime |

| Abstract: The Single Essential theory of the consequences of the crime, either relates to the object of the crime or to the object of behavior. But both of them are contradicted to the principle of the criminal law. The multi-level essential theory of the consequences of the crime derives from the Single Essential theory, including the harm to the object of crime and the damage to the object of the behavior. But the current division of the multi-level of the consequences of the crime contains technical flaw, and the harm to object of crime is the evaluation of the crime, not the real result causes by criminal behavior. So the damage to the behavior object which severs to the object of crime is the result of the meaning of causality, and it is the core of the consequences of the crime. This result is connected with the result which the criminal law aims to prevent closely. In the explanation and application of the criminal law, the consequences of the crime includes both the structure result and the non-structure result. This tow kinds of results can be applied to the result crime and the behavior crime simultaneously. To treat the consequences of the crime as the damage to the behavior object of the crime enables the evaluation of the crime to touch the facts of the crime. |
