基本权利理论视阈中的劳动权规范领域 |

| 摘 要： 确定劳动权的规范领域是劳动权保障的先决条件，只有规范领域内的劳动权才受保障。劳动权规范领域与劳动权保障程度密切相关，规范领域越广，国家侵害的可能性就越大；规范领域越窄，国家侵害的可能性就越小。劳动权规范领域的确定需借助宪法诉讼、宪法解释，中国语境下宪法解释更具意义，在策略上宜实行“分层的二元解释”，对自由权层面的劳动权实行“扩张解释”，对社会权层面的劳动权实行“限缩解释”。具体而言，“对人的主观规范领域”和“对行为与内容的客观规范领域”共同构筑了完整的劳动权规范领域。 |

| Abstract: Determined the mormative areas of labor rights is a prerequisite to protect labor rights, only the right classified in the mormative areas of labor was protected. The mormative areas of labor rights are closely related to the extensive of labor right’s protection; the more extensive the labor rights regulate, the more likely the country apposes, rather than vise versa. Defined the mormative areas of labor rights standards requires constitutional litigation and constitutional interpretation, and the interpretation of the Constitution is more significant in the context of China, the strategy should be implemented with “hierarchical interpretation of the dual”, the labor rights in area of freedom for the “expansion of interpretation”, the labor rights belonged to the social rights for “limited explanation.” Specifically, the “areas of subjective norms” and “areas of acts’ and content’s objective norms” Co-found the complete areas of labor rights. |
