论新民主主义检察权的形成 |

| 摘 要： 新民主主义检察权自苏区政权建立始，其发展历程直至我国独立自主的检察制度的建立，迭经撤废，步履维艰。由于社会制度选择的导向性以及边区政府的特殊性，在新民主主义检察权形成的过程中，前苏联和南京国民政府的影响均至关重要。但是，由于在制度移植过程中的开放性和自主性要求，外在法域对我国新民主主义检察权的影响，又表现出与自身特色相呼应的拿来主义和阶段性特征，并不必然表现为通常所认为的那样是对前苏联模式亦步亦趋的被动移植。 |

On formation of new-democratic procuratorial power |

| Abstract: The developing process of new-democratic procuratorial power had been revoked and walked difficultly from the establishment of Soviet area regime to the beginning of China’s independent and initiative procuratorical system. Because of the guideness of social system and the particularity of the border area government, the Soviet Union and GuoMin government had an great effect on the formation process of the new-democratic procuratorial power. As the open and autonomy in the transplant process, however, the foreign legal had an impact on the formation of China’s new-democratic procuratirial power and had the localised and staged characteristics. |
