论共同犯罪性质的认定——以整体犯罪构成为视角 |

| 摘 要： 整体犯罪构成是指两人以上的共同行为所符合的犯罪构成。不管是否采纳修正的犯罪构成概念，整体犯罪构成都是认定共同犯罪的基础；整体犯罪构成要和共犯的成立条件相区分，作为整体犯罪构成评价对象的事实行为要结合单独犯罪来确立；在共同犯罪中，只要有利用身份的情况出现，就可以认为构成相应的身份犯，如果同时满足非身份犯的犯罪构成，就形成了非常特殊的想象竞合关系。 |

On identification of the quality of joint offence: Based on the overall constitution of crime |

| Abstract: The overall constitution of crime is the constitution which is comprised of joint act which two or more people implementing. Regardless of adopting the conception of amendatory constitution of crime, the overall constitution of crime is the basis of definiting crime, and the overall constitution of crime differs from the component conditions. Factual behavior, as the appraisal object of the overall constitution of crime, needs to definite with singular crime. In a joint offence, status crime can be confirmed when someone takes advantage of it, at the same time, when the constitution of non-status crime can be confirmed, thus a special relationship of imaginative superposition will come into being. |
