| 摘 要： 暴力拆迁案件频繁发生，引起人们对当前拆迁制度的反思。以法经济学基本理论为依托，采用实证的分析方法，解析引发拆迁冲突的内在诱因，同时借用理性行动者模型剖析不少政府官员在拆迁过程中“偏好”使用暴力之原因，并在此基础上试图探寻祛除附在政府官员身上的“暴力鬼魅”之方法，以期实现和谐拆迁。 |

Game of rights and power: an analysis of law and
economics of “forced relocation” |

| Abstract: Because of the cases of forced relocation frequently happened, we should think profoundly about the current institutions of Legal System of Urban Housing Demolition. The authors try to analyse the reasons that the conflicts breaking out during the urban housing demolition. At the same time, they also want to find the reasons that the government preferring to violence. The methods the paper using are empirical, and Law and Economics theory are based on the basic theory. At last, on this basis attached to the government in an attempt to explore the body to eliminate the “ghost of violence” methods in order to achieve harmony demolition. |
