救助行为人请求权探析 |

| 摘 要： 在危难时刻实施了救助行为的救助人的合法权益是否得到充分保护是法律公平正义与否的具体体现。作者在明确救助行为确切含义的前提下，将救助行为划分为两大类别，即因事实因素导致的危险救助和因行为因素导致的危险救助。主张因行为因素导致的危险救助中，救助人对加害人和被救助人分别享有请求权，对前者的请求权处于第一顺序，具有优先性。 |

On right of claim of rescuer in danger |

| Abstract: The protection of the rights and interests of the rescuer in danger embodies fairness and justice in law. On the premise of clarifying the precise meaning of it, rescue action can be divided into two kinds. As for the rescue action resulting from action, the rescuer has the right of claim on the injurer and the person rescued respectively, and the right of claim on the former lies in the first place and takes precedence. |
